How to write a rent-a-car agreement (with a template)

A rental agreement does two jobs: it sets out what both sides agreed, and it gives the showroom something to point to if things go wrong. It does not need to be long. It needs to be clear and consistent.

This is general information, not legal advice. Have a lawyer review your final wording, especially the liability and insurance clauses.

What every rental agreement should cover

• Parties. Showroom name and contact; renter's full name, CNIC number, licence number, address and phone.
• Vehicle. Make, model, year, registration number, colour, odometer at check-out, fuel level at check-out.
• Period. Date and time out, date and time due back.
• Charges. Daily rate, number of days, total; the grace period and the hourly overtime rate; any delivery or driver charges.
• Security deposit. Amount, form (cash or held CNIC), and exactly what it can be deducted for.
• Fuel. Return-as-received, or full-to-full, stated plainly.
• Mileage. Unlimited, or a daily allowance with a per-kilometre charge over it.
• Condition. A reference to the attached check-out condition record that the renter has signed.
• Damage and loss. Who pays for new damage, and how it is assessed; what happens if the vehicle is not returned.
• Use restrictions. Named drivers only; no sub-letting; no use for hire without permission; no off-road unless it is a 4x4 hire; no driving under the influence.
• Insurance. What cover exists, the excess the renter is liable for, and what voids it.
• Signatures. Both parties, with date, at check-out.
